Terms and Conditions for Ngamaia Farms

Ngamaia Farms, a New Zealand-based honey producer, is committed to protecting the privacy of our customers. This Privacy Policy describes the information we collect, how it is used, and the choices available to you regarding our use of your personal information.

1. Information Collection and Use

Ngamaia Farms Quality Honey (“NGAMAIA FARMS”, “we”, “us”, or “our”) is committed to providing high-quality honey to our customers. These terms and conditions (“Terms”) govern the sale of honey by NGAMAIA FARMS to you through our website (https://www.ngamaiafarmsqualityhoney.co.nz/) and at our retail store located in New Zealand. By placing an order through our website or in-store, you agree to be bound by these Terms.

2. Ordering and Payment Terms:

a. Domestic Sales: i. For domestic sales of honey, we sell Ex-Works, which means that our bulk customers are responsible for organizing and paying for freight themselves.

b. International Sales: i. A 30% deposit is required on acceptance of the order, with the remaining amount due before the product is shipped. This deposit is non-refundable. A one month lead in time is required for each jar order made. ii. For drum orders, full payment is required before the product leaves the factory. iii. For all international sales, the terms of trade will be FOB (Free on Board), which means that we pay to get the honey to the port of Auckland and the buyer assumes the risk and cost of arranging transportation, customs, insurance, etc. once the product arrives in Auckland. The cost of transport, Ecert, and ED is included in the cost of jarring the honey. iiii. The cost of the transportation of bulk honey in drums is the buyer’s expense.

 

3. Shipping and Delivery

  2. i. all jar orders will be sold on a Free on Board (FOB) basis. This means that NGAMAIA FARMS will pay to get the honey to the port of Auckland, but once it arrives there, it will be at the risk and cost of the buyer to arrange transportation, customs, insurance, etc. The cost of the transport and the necessary certification and export documentation (Ecert and ED) are built into the cost of the jarred honey.

  3. ii.For shipping of bulk honey in drums – The cost to transport 4 x drums of honey would be $250 (incl. GST). An additional $200 + GST will be charged for an export declaration Cert from NGAMAIA FARMS to the freight company ie: Mainfreight.

4. Returns and Refunds

Due to the nature of our business and the costs associated with producing and jarring honey, all sales are final and no refunds will be given.

5. Product Information

NGAMAIA FARMS takes great care to ensure that the information on our website and in our retail store is accurate and up-to-date. However, we do not guarantee that the information is error-free, complete, or current. Product descriptions, prices, and availability may change without notice.

6. Limitation of Liability

NGAMAIA FARMS will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products. Our liability is limited to the purchase price of the product.

7. Intellectual Property

All content on our website and in our retail store, including but not limited to text, graphics, logos, images, pricing and software, is the property of NGAMAIA FARMS and is protected by international copyright laws. You may not use any content without the express written consent of NGAMAIA FARMS.

8. Governing Law

These Terms will be governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms will be resolved in the courts of New Zealand.

9. Changes to Terms

NGAMAIA FARMS reserves the right to make changes to these Terms at any time. Your continued use of our website or purchase of our products after any changes have been made constitutes your acceptance of the new Terms.
